  1. The objective of the EUROCONTROL ATM Lexicon is to facilitate wide dissemination and exchange of ATM, Air Navigation and Air transport terms to and between aviation professionals. The information uploaded in the EUROCONTROL ATM Lexicon (in whichever format, i.e. all documents, data, articles, representations, statements) originates from various sources and authors contributing to the EUROCONTROL ATM Lexicon. The information is periodically reviewed and edited by EUROCONTROL in an endeavour to present the information in a uniform format.
  2. However, the use of this EUROCONTROL ATM Lexicon is at the User’s sole responsibility and risk. EUROCONTROL expressly disclaims any warranty with respect to the information in the EUROCONTROL ATM Lexicon and on the website, including its accuracy, completeness, reliability, quality, fitness for a particular purpose, representation of state-of-the-art technology or regulation. In particular, EUROCONTROL does not warrant the accuracy and completeness of any reference to rules and regulations, features or practices presented in the information. The user may create links to the EUROCONTROL ATM Lexicon from other websites, but only in accordance with the following terms and in compliance with all applicable laws:

Absent EUROCONTROL’s written authorisation otherwise, a website that links to the EUROCONTROL ATM Lexicon:

  1. may link to, but shall not replicate, any materials (including EUROCONTROL logo);
  2. shall not create a browser or border environment around any materials;
  3. shall not imply that EUROCONTROL endorses such website or any products, services, or content available through such website;
  4. shall not misrepresent its relationship with EUROCONTROL;
  5. shall not present false or misleading information about EUROCONTROL, its products, or its services;
  6. shall not contain content that could be construed as distasteful, offensive, or controversial; and
  7. shall contain only content that is appropriate for all age groups.

LICENCE AGREEMENT

Preamble

The objective of the EUROCONTROL ATM Lexicon is to facilitate wide dissemination and exchange of ATM, Air Navigation and Air transport terms to and between aviation professionals. The EUROCONTROL ATM Lexicon is owned and managed by EUROCONTROL. The information uploaded in the ATM Lexicon (in whichever format, i.e. all documents, data, articles, representations, statements) originates from various sources and authors contributing to the EUROCONTROL ATM Lexicon. The information is periodically reviewed and edited by EUROCONTROL in an endeavour to present the information in a uniform format.

Definitions

Terminological entry (hereafter referred to as “Entry”) means any information relating to a term or the concept designated (including for instance the term, equivalents, alternate terms, definitions, contexts, sources, and subject fields). The Entry may be composed of various elements, such as text, graphic elements, tables or other.

Author means a person who contributes to the EUROCONTROL ATM Lexicon by providing relevant expert knowledge regarding an Entry in the EUROCONTROL ATM Lexicon. The Author is a registered User of the EUROCONTROL ATM Lexicon. Authors will have to be accepted by EUROCONTROL before providing Entries.

EUROCONTROL – is the European Organisation for the Safety of Air Navigation, with its seat at Brussels, Belgium. EUROCONTROL may be an Author and a User of the EUROCONTROL ATM Lexicon within the scope of this Licence Agreement. Marked Parts means those parts of an Entry that visibly display the following copyright notice: © [year] [name]. Such parts may, for example, be text, images, tables or graphs. Those parts are not modifiable parts and not subject of the rights of the User under this Licence Agreement.

Modified Version means any further version of an Entry or its parts which are not marked parts, other than the original Entry. It may be created by the Author of the original Entry or any other Author under this Licence Agreement. Original Version means the first version of an Entry at the time the Entry was created by the Author.

EUROCONTROL ATM Lexicon means a ‘wiki-type’ platform, dedicated to facilitate wide dissemination and exchange of ATM, Air Navigation and Air transport terms to and between aviation professionals primarily through a database of terminological entries and other functionalities, such as a discussion forum. EUROCONTROL is responsible for all technical aspects, content managing and layout of the EUROCONTROL ATM Lexicon.

User means any person accessing the EUROCONTROL ATM Lexicon on the internet and thereby having the possibility to view or make other use of the Entries contained in the EUROCONTROL ATM Lexicon. Users will have to register in order to become Authors or participate in a discussion.

Purpose and Scope

  1. The purpose of this Licence Agreement is to define the rights and obligations of the Authors and Users of the EUROCONTROL ATM Lexicon concerning the intellectual property rights (exploitation rights, usage rights) related to Entries and parts of Entries contributed to the EUROCONTROL ATM Lexicon by the Authors.
  2. Any documents which are accessible through internet links contained in the EUROCONTROL ATM Lexicon are outside the scope of this Licence Agreement.

Conclusion of the Licence Agreement

  1. By submitting a contribution to an Entry (Original Version or Modified Version) to the EUROCONTROL ATM Lexicon by the technical means foreseen on the EUROCONTROL ATM Lexicon website the Author offers to any potential User of the EUROCONTROL ATM Lexicon to make use of the Entry subject to the terms of this Licence Agreement.
  2. This Licence Agreement is concluded between EUROCONTROL and the Author / User of the EUROCONTROL ATM Lexicon at the moment the Author / User accesses an Entry contained in EUROCONTROL ATM Lexicon.

Scope of the Licence

  1. The rights granted to the User shall be non-exclusive, unlimited in time and free of charge.
  2. The User shall have the rights to copy, print, download, publish, distribute or otherwise provide or make accessible the Entry, to the public for his own purposes and free of charge. Any copy of the Entry or its parts shall display the following reference to the EUROCONTROL ATM Lexicon and – if displayed in the original version – to its author: “Source: www.eurocontrol.int/atmlexicon, As regards Marked Parts of the Entry, the User shall only have the right to download and print them for his own purposes.
  3. The User may not grant sub-licences to Third Parties other than set out in Scope of the Licence (2)
  4. The User shall have the right to modify the modifiable parts of an Entry (i.e. those which are not Marked Parts) on the conditions that the Modified Version displays the following reference to the EUROCONTROL ATM Lexicon, the original version and – if displayed in the original version – to its author: “based on the Entry [title of Entry], [author name], source: www.eurocontrol.int/atmlexicon”.
  5. With regard to the modified version, the User shall have the rights set out under Scope of the Licence (2) above.
  6. The rights of the User set out in Scope of the Licence (2 and 3) above shall not limit or modify the rights of the Author with regard to the same Entry under this Licence Agreement.

Liability

  1. The Author warrants that he holds all necessary intellectual property rights to an Entry, its parts, the original or Modified version, allowing him to submit that Entry to the EUROCONTROL ATM Lexicon subject to this Licence Agreement.
  2. The Author warrants that by submitting a contribution to an Entry to the EUROCONTROL ATM Lexicon he does not infringe any third parties’ intellectual property rights.
  3. The Author shall hold EUROCONTROL harmless from any claims for damages made by third parties for the infringement of their intellectual property rights caused by the Author in breach of his obligation under Conclusion of the Licence Agreement (1) above.
  4. Notwithstanding the provisions under Conclusion of the Licence Agreement (1 and 2) above, the liability of the User and Author under this Licence Agreement shall be limited to gross negligence and wilful misconduct.

Termination

  1. In case of breach of the terms of this Licence Agreement by the User, the rights of that User set out in Scope of the Licence shall expire with immediate effect. Any sub-licences granted by the User in accordance with Scope of the Licence (3) above shall not be affected.The Author may terminate this Licence Agreement any time by giving notice to EUROCONTROL by the EUROCONTROL ATM Lexicon e-mailing function. Upon receipt of the notice, EUROCONTROL shall withdraw the Entry from the EUROCONTROL ATM Lexicon without undue delay.
  2. In case of termination as set out in paragraph 2 above, any exploitation of the Entry carried out until the time of withdrawal of the Entry from the EUROCONTROL ATM Lexicon shall be within the scope of this Licence Agreement.
  3. Neither Author nor User shall be entitled to claim damages arising out of or after the termination of this Licence Agreement.

Amendment of the Licence Agreement

  1. EUROCONTROL may from time to time amend this Licence Agreement.
  2. The new version shall be made available on the EUROCONTROL ATM Lexicon and shall become effective from that date and be applicable to contributions subsequently submitted to the EUROCONTROL ATM Lexicon.

Applicable Law and Jurisdiction

This Agreement shall be subject to Belgian Law. The competent courts shall be the courts of Brussels.

CODE OF CONDUCT

  1. Only registered Users / Authors of the EUROCONTROL ATM Lexicon website may submit contributions to the EUROCONTROL ATM Lexicon Discussion Pages.
  2. The contribution must be directly linked to the terminological entry or previous entries on the Discussion Page.
  3. The EUROCONTROL ATM Lexicon Discussion Pages are dedicated to discussions between the Users. Therefore, the User shall not attach files to his contribution which consume a large amount of data (such as pictures, long text from other sources etc.). Links to other websites are usually sufficient. Attached files may be removed without notice if they are considered to be too large.
  4. The following is strictly prohibited:
    1. use of the EUROCONTROL ATM Lexicon Discussion Pages for commercial purposes;
    2. defamatory, offensive or otherwise unacceptable content;
    3. content, the dissemination of which is a criminal offence.
  5. The User is requested to report any content of the EUROCONTROL ATM Lexicon Discussion Pages which falls under paragraph 4 above to EUROCONTROL (by use of the contacts function).
  6. Any intellectual property rights in the Entry as a whole remain with the Author, who, by submitting his Entry grants an unlimited, free-of-charge, exclusive licence to EUROCONTROL to use the contribution as a whole or parts of it for the purposes of the EUROCONTROL ATM Lexicon, including the Discussion Pages as well as for editing of existing EUROCONTROL ATM Lexicon Entries or the creation of new ones.
  7. The personal data submitted by the User / Author for registration purposes shall be kept confidential by EUROCONTROL and be used for the administration of the EUROCONTROL ATM Lexicon Discussion Pages only. The personal data shall be deleted immediately once the User / Author deregisters from the EUROCONTROL ATM Lexicon website.
  8. EUROCONTROL reserves the right to remove any contribution in whole or in part from the EUROCONTROL ATM Lexicon Discussion Pages and to block the User’s IP address and username without prior notice at its discretion, in particular in cases of prohibited conduct of the User as set out in paragraph 4 above.
